We all know there are a number of factors, not the fault of the consumer, that can put a person into financial distress: loss of job or reduction in hours, major medical expenses not cover by insurance, divorce or separation, adjustments to mortgage payments, unilateral changes in the terms of credit accounts, etc. Filing for bankruptcy court protection from your creditors is one way to seek relief.
A Chapter 7 straight bankruptcy filing, preferably with an experienced bankruptcy lawyer, would provide you with immediate relief, as you would be able to discharge your unsecured debt (with a few possible exceptions, such as student loans). The bankruptcy filing known as a Chapter 13 debt repayment plan may also be available, in particular if you are behind on your mortgage and are trying to save your home, or if you otherwise do not qualify for a Chapter 7 (such as if you had a prior Chapter 7 discharge within the past eight years).
